SC Stays High Court Transgender Law Cases
The Supreme Court on Monday stayed proceedings before several High Courts hearing petitions challenging the Transgender Persons law, after the Centre sought transfer of the cases. The court will now examine whether the matters should be heard together by the Supreme Court or assigned to one High Court.
Supreme Court Stays Transgender Law Cases
The petitions challenging the amended transgender rights law are pending before multiple High Courts, including those in Delhi, Karnataka, Kerala and Rajasthan. The Centre argued that separate proceedings could lead to conflicting rulings on the constitutional validity of the law.
A Supreme Court Bench issued notice on the transfer plea and stayed the High Court proceedings for the time being. The stay applies to the ongoing court cases and does not amount to a stay on the law itself.
Transgender Persons Law Under Challenge
The petitions challenge amendments to the Transgender Persons (Protection of Rights) law. One of the key objections relates to the process for official recognition of transgender identity.
Petitioners have questioned provisions requiring a designated medical board’s recommendation before a District Magistrate can issue a certificate of identity. They argue that such requirements may affect the principle of self-identification recognised in earlier Supreme Court rulings.
Centre Seeks Transfer Of High Court Pleas
The Centre has sought consolidation of the cases to avoid multiple courts examining the same legal questions separately. The Supreme Court may decide whether to hear the constitutional challenge itself or transfer all related petitions to one High Court.
The next stage of the case will determine how the legal challenge to the transgender law proceeds and whether the amended recognition process will face closer judicial scrutiny.
