SC Signals Quashing of Student Protest FIRs
The Supreme Court on Tuesday indicated that it intends to quash FIRs registered against students who participated in recent protests over examination paper leaks and other recruitment-related issues. The Court, however, clarified that the protection would not extend to individuals with histories of serious criminal offences who allegedly infiltrated the demonstrations.
Supreme Court May Quash Student Protest FIRs
A Bench headed by Chief Justice of India Surya Kant was hearing petitions alleging excessive police force against students during protests held across several states from July 20 onwards.
The Court indicated that cases against genuine student protesters could be quashed, while distinguishing them from individuals with previous records involving grievous offences.
The proceedings cover protests and alleged police action in Delhi, Assam, Bihar, West Bengal, Uttar Pradesh, Madhya Pradesh, Maharashtra and Kerala.
Panel to Probe Alleged Police Excesses
The Supreme Court also reiterated its intention to establish a high-powered committee to examine allegations surrounding the use of police force during the demonstrations.
The proposed panel is expected to include a former Supreme Court judge, a former High Court judge and a retired senior police officer. It would undertake a fact-finding exercise into allegations of excessive force and other complaints arising from the protests.
Petitions have sought scrutiny of actions including the alleged use of pellet guns against demonstrators.
Delhi Police Defends Action During Protests
Delhi Police has denied allegations of excessive force, maintaining that officers exercised restraint and used only the force necessary to control the situation.
Police have also claimed that individuals with serious criminal histories infiltrated demonstrations and contributed to violence. The Supreme Court is examining petitions from students as well as submissions involving injured police personnel and media workers.
