Allahabad HC Withholds FIR Order On Rahul Gandhi
The Allahabad High Court has withheld its order on directing registration of an FIR against Congress leader and Leader of Opposition Rahul Gandhi in the British passport case. The matter relates to allegations that Gandhi was shown as a British national in records linked to a UK-based company, but the court has now decided to pause before issuing any such direction.
British Passport Case Against Rahul Gandhi
The case was brought by a petitioner who alleged that Rahul Gandhi had declared British nationality in documents connected to a UK-based company. Based on that claim, the petitioner sought criminal proceedings under multiple laws, including passport and nationality-related provisions. The matter had earlier reached the High Court after a lower court refused to order registration of a criminal case.
Allahabad High Court Withholds FIR Direction
The High Court had initially found that a prima facie case existed and had reportedly indicated that the matter could be referred for investigation. However, before the judgment could be formally signed, the court revisited the legal position and observed that Rahul Gandhi may need to be heard first before any direction for investigation or FIR is issued.
Court Cites Need To Hear Proposed Accused
The change came after the court referred to an earlier Full Bench ruling which said that a person who is likely to be affected by such an order should be given an opportunity to be heard in revision proceedings. On that basis, the court decided to withhold the order and list the matter again for hearing. No formal notice has yet been issued to Rahul Gandhi, and the case is now scheduled for further hearing on April 20.
