The United States has retained India on its Priority Watch List for intellectual property rights in its 2026 Special 301 Report, citing continuing concerns over patent rules, copyright enforcement and protection of American business interests.

The Priority Watch List is part of the annual Special 301 Report released by the Office of the US Trade Representative. The report reviews how trading partners protect and enforce intellectual property rights.
India has been listed along with Chile, China, Indonesia, Russia and Venezuela. The designation does not automatically mean sanctions, but it places the country under closer trade scrutiny.
US Flags Patent And Copyright Concerns
The report raised concerns over India’s intellectual property framework, including patent protection, enforcement delays, copyright piracy, trademark issues and market access barriers.
Pharmaceutical patents remain one of the most sensitive areas. India has long defended its legal framework by arguing that it balances innovation, affordability and public health needs, especially for generic medicines.
What It Means For India-US Trade
India’s inclusion on the list may add pressure during future trade talks with Washington, particularly in sectors such as pharmaceuticals, technology, software, entertainment and digital services.
However, the listing is not new and reflects a long-running disagreement between India and the United States over intellectual property rules. New Delhi is expected to continue defending its system as compliant with global trade norms while engaging with Washington on specific concerns.
