
SC Seeks Response on Transgender-Inclusive Sex Education
A Class 12 student from Vasant Valley School in Delhi has filed a plea in the Supreme Court seeking the inclusion of transgender-inclusive Comprehensive Sexuality Education (CSE) in school curricula and textbooks nationwide, citing the omission in NCERT and SCERT content.
Supreme Court Seeks Responses
The Supreme Court has issued notices to the Union government, NCERT, and six states—including Maharashtra, Punjab, Karnataka, and Tamil Nadu—requesting responses to the plea. The bench, led by Chief Justice Bhushan R. Gavai, also noted that a 2014 apex court ruling had already directed gender inclusion measures at the policy level.
Legal and Constitutional Grounds
The plea argues that the omission of transgender-inclusive content from educational materials violates constitutional protections under Articles 14, 15, 19(1)(a), 21, and 21A, as well as Directive Principles. It also highlights non-compliance with provisions of the Transgender Persons (Protection of Rights) Act, 2019, which mandate inclusive education.
