US Embassy Warns Against Birth Tourism
The US Embassy in India has issued a clear advisory stating that tourist visa applications will be rejected if consular officers believe the primary purpose of travel is to give birth in the United States so the child can obtain US citizenship. The embassy said that such intent violates the permitted use of B-1/B-2 tourist visas.
Embassy Clarifies Visa Rules
Officials explained that visitor visas are strictly for tourism, short business trips and similar temporary travel. If an applicant is suspected of planning a trip mainly to deliver a baby in the US, the visa can be refused. The embassy emphasised that this falls under visa misuse and can also impact future applications if misrepresentation is detected.
Birthright Citizenship and Concerns
Under the 14th Amendment of the US Constitution, most children born on US soil automatically receive citizenship. Authorities have raised concerns about people attempting to exploit this system by entering the country on tourist visas solely for childbirth. The latest advisory aims to reaffirm that such travel is not allowed and will be scrutinised during visa interviews.

The embassy urged applicants to be transparent about their travel plans and ensure their purpose aligns with allowable visa categories. Failure to do so may result in denial or additional restrictions on future US travel.
