Vande Mataram disruption penalty

The Centre has introduced legislation in the Rajya Sabha seeking to make the intentional disruption or obstruction of “Vande Mataram” punishable with imprisonment, a fine or both. Vande Mataram Bill in Rajya Sabha Union Home Minister Amit Shah introduced the Prevention of Insults to National Honour (Amendment) Bill, 2026, during Parliament’s Monsoon Session. The legislation proposes amendments to the Prevention of Insults to National Honour Act, 1971. The existing law protects the National Flag, the Constitution and the National Anthem from specified acts of insult or disruption. The proposed amendment would extend comparable statutory protection to “Vande Mataram”, India’s National Song. Three-Year Jail Term Proposed Under the Bill, anyone who intentionally prevents the singing of “Vande Mataram” or causes a disturbance during its rendition could face imprisonment of up to three years, a fine or both. The penalty mirrors the existing punishment for deliberately preventing the singing of the National Anthem or disturbing a gathering engaged in its rendition. Repeat offences under the wider law can attract a minimum prison term of one year. The proposal does not become law merely upon introduction. It must be approved by both Houses of Parliament and receive presidential assent before its provisions can take effect. National Song Gets Legal Protection The government has said the amendment is intended to address the absence of a specific legal provision dealing with deliberate obstruction or disturbance during the singing of “Vande Mataram”. Written by Bankim Chandra Chattopadhyay and associated closely with India’s freedom movement, “Vande Mataram” is being commemorated through events marking 150 years since its composition. The Bill is expected to be examined and debated during the parliamentary process.
