Trump visa restrictions – Bharat Pulse News

A US federal judge has blocked a Trump administration rule that would have imposed fixed limits on how long foreign students, exchange visitors and international journalists could remain in the United States without seeking extensions. The policy had been scheduled to take effect on September 15. Judge Blocks New US Student Visa Rules US District Judge F. Dennis Saylor IV in Massachusetts postponed the rule’s effective date and barred the Department of Homeland Security from implementing it while a legal challenge continues. The proposed system would have replaced the long-standing “duration of status” framework for many foreign students and exchange visitors. Under the rule, F and J visa holders would generally have been admitted for their programme duration up to a maximum of four years, after which an extension would be required. Foreign journalists using I visas would have faced a maximum initial admission period of 240 days, with extensions required for longer assignments. Court Questions DHS Justification for Restrictions Saylor found that the challengers had shown a substantial likelihood of succeeding in their case under the Administrative Procedure Act. The judge questioned whether the government had adequately justified such a major change to a system that has operated for decades. The administration has argued that fixed admission periods would strengthen immigration enforcement, reduce visa abuse and improve oversight of foreign nationals remaining in the country. Existing Visa System Remains in Place The ruling means the existing duration-of-status framework will remain in effect for now, providing temporary relief to international students, researchers and journalists who could have been affected by the new requirements. The decision does not permanently invalidate the Trump administration’s rule. The underlying lawsuit will continue, and the government may seek further judicial review as it defends the policy.
