The court emphasized the necessity of restraint, stating that repeated derogatory remarks could result in legal repercussions, including contempt of court proceedings initiated by the judiciary itself. Origin of the Case The matter originated from a defamation complaint filed against Rahul Gandhi for his remarks about Savarkar, a revered and controversial figure in Indian history. The complainant claimed that Gandhi’s statements were not just politically charged but personally defamatory, warranting judicial action. The magistrate court had taken cognizance of the complaint and issued summons for Gandhi’s appearance. Relief Granted, But With a Caveat While granting a stay on the summons, the Supreme Court stressed that the order should not be misconstrued as validation of Gandhi’s comments. The bench made it clear that the relief was procedural, not an endorsement of his speech. The Court reiterated its expectation that those in public life should contribute to a dignified and constructive discourse rather than stoking controversies through provocative remarks.
