The Delhi Police Commissioner has been authorised to exercise preventive detention powers under the National Security Act for three months, but police have rejected claims linking the notification to the ongoing CJP protests. Delhi Police Gets NSA Detention Powers A Delhi government Home Department notification authorises the Police Commissioner to exercise powers under the National Security Act from July 19 to October 18, 2026. The law permits preventive detention when authorities believe an individual may act in a manner prejudicial to national security, public order, India’s defence or the maintenance of essential supplies and services. The three-month period refers to the delegation of authority to the Police Commissioner, not the automatic duration of any individual detention. NSA Order Called Routine Renewal The notification’s timing attracted attention because it coincided with protests over the NEET-UG paper leak and demands for Education Minister Dharmendra Pradhan’s resignation. However, Delhi Police said the order was a routine quarterly renewal and had no connection with the CJP agitation. Officials said similar powers have been delegated to the Delhi Police Commissioner regularly since the 1980s. Therefore, claims that the powers were specifically granted “to quell” the current protests are not established by the notification itself. National Security Act Safeguards Explained An NSA detention order issued by an authorised officer must be reported to the government and generally ceases after 12 days unless approved. The detainee must ordinarily be informed of the grounds within five days, extendable to 10 days in exceptional circumstances. The case must also undergo review by an Advisory Board. Detention can continue for up to 12 months if confirmed through the statutory process, but authorities may revoke it earlier. The notification does not mean protesters can automatically be detained under the NSA. Any order must be based on the grounds prescribed by law and remains open to judicial challenge.
