India has just been handed a remarkably clear demonstration of how selectively the language of free speech is applied in contemporary politics. Within the space of a few days, Rahul Gandhi has adopted two visibly different standards for offensive political expression—one when Narendra Modi was the target and another when the government involved belonged to his own political ally. During the recent student protests in Delhi, demonstrators were accused of using deeply abusive language against Prime Minister Narendra Modi, with some of the remarks reportedly extending to his late mother. Police complaints and the possibility of action against those involved immediately became part of a wider political controversy. Modi subsequently appealed for forgiveness rather than prolonged punishment, describing the protesters as misguided youngsters and arguing that dragging them through courts would not address their underlying grievances. Rahul Gandhi, however, did not respond by condemning the abuse and then questioning whether police action was proportionate. Instead, he portrayed the controversy as another attempt by the Modi government to silence Gen Z. He attacked the Centre over the cases, stood firmly with the protesters and later told student representatives that they had no need to apologise for raising their voices. Then came Tamil Nadu. Udhayanidhi Stalin, the DMK leader and Leader of the Opposition in the Tamil Nadu Assembly, was arrested by the police controlled by Chief Minister C. Joseph Vijay’s government. The case arose from remarks made during a Cauvery-water rally after members of the crowd chanted actress Trisha Krishnan’s name. Udhayanidhi’s response was interpreted by his opponents as a vulgar double entendre concerning Vijay’s reported friendship with the actress. He denied the interpretation, but the police arrested him, questioned him and later released him on station bail. The remark was certainly open to criticism. Political leaders should not drag women into personal attacks against male opponents, and the habit of using insinuations about a woman’s relationships as ammunition in political battles deserves unequivocal condemnation. But criticism of Udhayanidhi’s language does not automatically justify the arrest of the Leader of the Opposition. Nor does it answer the uncomfortable question now facing Rahul Gandhi: why does his defence of political expression appear to disappear the moment the police power being exercised belongs to Vijay, his ally? When Abuse Against Modi Became a Free-Speech Cause The student protests were not merely polite gatherings in which young people calmly submitted a memorandum about examination reform. The demonstrations became confrontational, police and protesters accused each other of violence, and videos circulated showing abusive language being directed at the Prime Minister. Rahul Gandhi nevertheless chose to place almost the entire moral burden on the government. He demanded accountability for the police response, accused the establishment of suppressing the youth and presented the protesters as representatives of a generation whose frustration deserved to be heard. There was a legitimate argument to be made against excessive policing. Students protesting examination leaks, unemployment and institutional failures do not lose their constitutional rights merely because some people within a crowd behave irresponsibly. But Gandhi’s intervention conspicuously lacked the balance he now expects others to show. He could have defended the right to peaceful protest while clearly condemning the personal abuse directed at Modi and his deceased mother. He could have argued against criminal prosecution while also recognising that political anger does not provide a licence for dehumanising language. Instead, the dominant message was that the government was trying to silence Gen Z. The misconduct of the protesters was pushed into the background because Narendra Modi was the political target. When Modi appealed for forgiveness rather than punishment, Rahul Gandhi reportedly responded that India’s students did not need the Prime Minister’s forgiveness. That position transformed a dispute over specific acts of abusive speech into a sweeping confrontation between a repressive establishment and a heroic generation. The question now is whether Gandhi believes that principle universally—or only when it can be deployed against Modi. Vijay’s Government Uses the Police Against the Opposition The Tamil Nadu controversy presents Rahul Gandhi with an almost perfect test of consistency. Udhayanidhi was not accused of organising violence, attacking a police officer or threatening an imminent act of physical harm. The immediate controversy concerned an allegedly suggestive remark whose meaning depended heavily on context, crowd chants and interpretation. His opponents regarded the remark as vulgar and misogynistic. BJP leaders Khushbu Sundar and Kangana Ranaut publicly condemned it, with both arguing that obscene jokes involving women have no place in political discourse. That condemnation is understandable. Trisha is an individual in her own right, not a prop to be dragged into a contest between Vijay and Udhayanidhi. Women should not have their dignity treated as collateral damage whenever male politicians exchange personal attacks. But the government did not stop at condemnation. The police machinery moved against the Leader of the Opposition, arrested him at his residence, questioned him and turned an objectionable political remark into a criminal confrontation. The arrest was criticised not only by Udhayanidhi’s party colleagues but also by figures who were hardly natural defenders of the DMK. Reports noted that leaders across political lines questioned whether the scale and manner of the operation were proportionate. Udhayanidhi alleged that thousands of police personnel had been deployed as though the authorities were confronting a terrorist rather than an opposition politician accused of making a vulgar comment. This is precisely the kind of police action that Rahul Gandhi usually describes as intimidation when it occurs under a BJP government. Yet the speeches about constitutional liberty have suddenly become difficult to locate. Crude Speech Is Not a Criminal Emergency One of the most dangerous habits in Indian politics is the growing belief that every insult must become an FIR and every offensive remark must end with an arrest. Politics is frequently crude, personal and unpleasant. The appropriate answer to offensive political speech is usually more speech: condemnation, rebuttal, public pressure, demands for an apology and electoral consequences. Where a statement crosses a clearly established legal boundary, the law may take its course. But arrest should not become the instinctive response merely because a chief minister, minister, political ally or celebrity feels insulted. The government possesses powers that ordinary citizens do not. It controls the police, prosecution machinery and administrative apparatus. That imbalance places a special responsibility on those in office to exercise restraint, particularly when dealing with political opponents. Udhayanidhi’s position makes the issue even more serious. He is the Leader of the Opposition in the Tamil Nadu Assembly. Arresting him over an ambiguous and allegedly vulgar remark inevitably raises questions about political intimidation, regardless of how objectionable his words may have been. A mature democracy should be capable of holding two thoughts simultaneously: Udhayanidhi’s remark may have been disgraceful, and Vijay’s government may still have responded disproportionately. Rahul Gandhi understands this distinction perfectly well when BJP-controlled authorities take action against protesters. Why has it become so difficult for him to articulate the same distinction in Tamil Nadu? Rahul Gandhi’s Sudden Silence As of the publication of this article, there has been no comparable public intervention from Rahul Gandhi condemning Udhayanidhi’s arrest or questioning whether Vijay’s government misused police power. That silence is particularly conspicuous because Gandhi has not been absent from public life. On the same day that the Tamil Nadu controversy dominated political discussion, he was publicly meeting student protesters and attacking Modi and Home Minister Amit Shah over alleged police brutality. He therefore had both the opportunity and the platform to speak. He could have condemned Udhayanidhi’s remark while opposing arrest. He could have defended Trisha’s dignity while warning Vijay against criminalising opposition speech. He could have shown that Congress applies the same democratic standards to its friends that it demands from its enemies. He did none of those things publicly. The contrast is difficult to ignore. When allegations involved police action against protesters hostile to Modi, Rahul Gandhi found the language of resistance immediately. When the Tamil Nadu government arrested its Leader of the Opposition, that language apparently deserted him. This is not principled silence. It looks like political convenience. Does Friendship Override Principle? Vijay is not merely the head of an unrelated state government. Congress backed Vijay’s TVK in forming the Tamil Nadu government after the 2026 Assembly election, ending its longstanding state-level alliance with the DMK. Congress also indicated that its relationship with TVK was intended to extend beyond government formation into future elections. The alliance was widely associated with the long political relationship between Vijay and Rahul Gandhi. Reports described their personal chemistry and years of contact as an important factor behind Congress’s decision to support the TVK-led government. That relationship makes Gandhi’s silence more—not less—important. A genuine ally is capable of telling a friend when he is wrong. A political leader claiming to defend democracy should be especially willing to challenge allied governments when they misuse state power. Instead, the impression being created is that Vijay enjoys an exemption from the democratic standards Rahul Gandhi imposes on Modi. When the BJP governs, every police complaint becomes evidence of authoritarianism. Every detention becomes an attack on democracy. Every confrontation with protesters becomes proof that the government fears dissent. But when Vijay’s government arrests the Leader of the Opposition over an alleged double meaning, Rahul Gandhi apparently sees no national democratic emergency. The Constitution cannot change according to the party controlling the police station. Free Speech Only When It Hurts Modi? Rahul Gandhi’s politics repeatedly presents him as a defender of dissent, constitutional values and the right to challenge authority. Those claims can only be taken seriously if they survive the test of political inconvenience. Defending speech aimed at one’s opponent is easy. The real test is whether the same principle is defended when the speech targets one’s ally. When Modi and his late mother were allegedly abused, Gandhi focused on the rights and grievances of the speakers. He warned the government not to silence Gen Z and rejected the idea that the protesters needed forgiveness. When an opposition leader made a vague but allegedly vulgar reference concerning Vijay and Trisha, Gandhi did not publicly extend the same concern to the speaker’s civil liberties. This does not mean the two remarks were identical. They occurred in different contexts, involved different speakers and generated different legal complaints. But the underlying democratic question is comparable: should offensive political expression be met with arrest and coercive police action? Rahul Gandhi appeared to answer “no” when Modi was the target. His silence suggests a very different answer when Vijay is the beneficiary. That is not a free-speech principle. It is a partisan permission structure. The Opposition Cannot Demand Standards It Will Not Follow Congress routinely accuses the BJP of weaponising police forces, investigative agencies and criminal laws against political opponents. Some of those accusations may be legitimate and deserve serious examination. But Congress cannot build credibility merely by repeating the word “democracy.” It must demonstrate that its principles also constrain governments it supports. The Tamil Nadu government survives with Congress backing. Congress cannot therefore pretend that the use of police power by Vijay’s administration is entirely someone else’s concern. When an allied government arrests the Leader of the Opposition, Congress has a greater responsibility to speak, not a smaller one. Rahul Gandhi cannot demand that Narendra Modi personally account for every police action in Delhi while treating Vijay’s government as politically untouchable. He cannot insist that BJP governments tolerate offensive dissent while allowing an ally to respond to an alleged insult with arrest. The standard must remain the same regardless of whether the chief minister’s name is Vijay or the prime minister’s name is Modi. Otherwise, every grand speech about constitutional morality becomes little more than campaign material. Udhayanidhi’s Remark Can Be Condemned Without Defending His Arrest There should be no confusion about what this argument does and does not defend. It does not defend misogyny. It does not suggest that politicians should make vulgar insinuations about women. It does not deny Trisha the right to dignity, privacy or legal remedies available to any citizen. Udhayanidhi should explain exactly what he intended. Where appropriate, he should apologise. His political opponents are entitled to condemn him, and the public is entitled to judge his conduct. But those positions do not require anyone to celebrate his arrest. This is the distinction Rahul Gandhi could easily have made. He could have said that Udhayanidhi’s alleged remark was unacceptable but that arresting the Leader of the Opposition over an ambiguous double entendre was disproportionate and dangerous. Such a response would have protected both principles: respect for women and restraint in the use of state power. His failure to make that distinction reveals the deeper problem. Gandhi’s concern does not appear to be the consistent defence of civil liberties. It appears to be the political identity of the government exercising coercion. Rahul Gandhi Must Answer Rahul Gandhi now faces questions that cannot be dismissed as partisan distractions. Why did he portray police action following abuse directed at Modi as an attempt to silence an entire generation, but remain publicly silent when Vijay’s government arrested the Leader of the Opposition? Why were the grievances of the student protesters sufficient to push their abusive conduct into the background, while no comparable consideration has been extended to an opposition politician accused of an ambiguous double entendre? Why must Modi show restraint towards those who abuse him, while Vijay apparently deserves silence when his police arrest a political rival? And most importantly: does Rahul Gandhi oppose the misuse of police power as a matter of principle, or only when the police answer to the BJP? Vijay’s government was entitled to condemn Udhayanidhi. Trisha was entitled to reject and challenge any degrading reference made about her. But the arrest of the Leader of the Opposition demanded scrutiny from every politician who claims to care about democracy. Rahul Gandhi’s silence is therefore not a minor omission. It strikes directly at the credibility of his politics. When abuse was aimed at Narendra Modi and his deceased mother, Rahul Gandhi became the defender of Gen Z and warned against silencing dissent. When Vijay’s government arrested Udhayanidhi, the defender of democracy disappeared. Unless he applies the same standard to his ally that he demands from Modi, Rahul Gandhi’s free-speech politics will stand exposed for what it increasingly appears to be: not a defence of liberty, but a weapon of political convenience.
