The Congress party's campaign against Chief Election Commissioner Gyanesh Kumar has taken an extraordinary turn. After weeks of demanding his resignation, questioning his legitimacy and staging protests against the Election Commission, Congress now finds itself presiding over a fresh Vigilance inquiry in Kerala into a corruption allegation dating back to 2006. On November 4, Kerala Home Minister Ramesh Chennithala directed the Vigilance and Anti-Corruption Bureau (VACB) to examine a contractor's complaint that Kumar had demanded a ₹2 crore bribe when he served as the state's Public Works Department secretary. The move follows another complaint, lodged by a Congress functionary, which prompted the state government to reopen scrutiny of the old matter in October. The chronology is difficult to ignore. Kerala is governed by the Congress-led United Democratic Front under Chief Minister V. D. Satheesan. Chennithala is a senior Congress leader. The man under investigation is the same constitutional officeholder whom the national Congress leadership has been relentlessly demanding should resign over the Special Intensive Revision of electoral rolls. None of these facts automatically makes an inquiry improper. But together they demand a convincing explanation. When an old case, previously closed for want of substantiated allegations, suddenly returns to life in the middle of a political confrontation, the public has every right to ask whether justice is being pursued or political pressure is being dressed up as accountability. A 2006 Controversy Returns in 2026 The underlying case concerns the World Bank-assisted Kerala State Transport Project and road works undertaken by the Indo-Malaysian PATI-BEL consortium. Malaysian engineer Lee See Been, associated with the project, died by suicide in Kuala Lumpur in November 2006 amid a dispute over delayed payments. Allegations subsequently surfaced that officials had sought bribes to release outstanding bills. Kumar, then Kerala's PWD secretary, became embroiled in the controversy and was moved out of the post. The state ordered a Vigilance inquiry, but the accusations were not established through that process. This is not merely Kumar's version of history. On October 14 this year, Chennithala himself told the Kerala Assembly that the VACB had investigated eight allegations linked to the project, including a claim of a ₹2 crore bribe demand, and recommended no further action because the allegations could not be ascertained. He also described inquiries into other road works that ended without substantiated irregularities. In 2012, he said, eight cases were reported to court as mistakes of fact, and the court accepted the reports. Congress cannot casually brush aside the record of earlier investigations merely because their outcome is politically inconvenient today. The Timing Is Congress's Problem On October 4, Chennithala ordered renewed Vigilance scrutiny after a complaint by Kerala Congress leader Malayinkeezhu Venugopal. Weeks later, contractor Sajan came forward with a more specific account. He alleges that Kumar withheld approved payments worth roughly ₹17 crore while demanding ₹2 crore, and says he can produce former project employees and Lee's family members as witnesses. Those claims are serious and investigators should examine the material offered. But an offer to produce evidence is not itself proof that a bribe was demanded, and a preliminary inquiry is not a finding of guilt. The purported suicide note, repeatedly invoked in public debate, has not been made publicly available. Now consider the national political backdrop. Rahul Gandhi has demanded Kumar's resignation and accused the Election Commission of compromising electoral democracy. Congress and its allies have organised protests over the Special Intensive Revision and the handling of electoral rolls. On October 7, Gandhi even declared that Kumar was not a legitimate CEC. On October 12, Opposition leaders marched towards the Supreme Court seeking his removal and challenging the revision exercise. These are not isolated expressions of disagreement. They form an organised campaign against the incumbent head of the Election Commission. The Kerala inquiry has entered that same political atmosphere, and Congress should not expect the country to pretend otherwise. When Political Arguments Give Way to Personal Attacks Congress has every right to challenge the Election Commission's decisions. Electoral-roll exclusions, administrative transparency and disagreements within the Commission are legitimate subjects of public scrutiny and judicial review. If the SIR has procedural flaws, those flaws must be identified, documented and corrected. That is how a responsible opposition holds an institution accountable. But a dispute about today's electoral administration does not become stronger merely because the party can revive a twenty-year-old allegation about the official's earlier career. The two matters require different evidence, different scrutiny and different standards of proof. What is especially troubling is the temptation to turn a political opponent's personal credibility into the battlefield when institutional arguments have not achieved the desired resignation. Congress has already made Kumar's removal a central demand. The appearance of an old corruption controversy in a Congress-governed state inevitably creates the impression of a second front. Perhaps investigators will uncover material overlooked years ago. If so, the facts should speak for themselves. Until then, Congress should explain why it is so eager to allow the allegation to become part of a national political spectacle before an inquiry has reached any conclusion. Constitutional Morality Cannot Be Selective Congress repeatedly positions itself as a defender of constitutional institutions. It invokes institutional independence, due process and democratic accountability whenever it criticises the Union government. Those principles, however, do not stop at the borders of a Congress-ruled state. The Kerala Home Department must apply the same restraint and procedural fairness that Congress demands from institutions controlled by its political rivals. A constitutional officeholder is not above investigation, but neither should an investigative agency become an instrument for settling an unrelated political dispute. The distinction matters because the Election Commission belongs to the Republic, not to the government of the day and not to the Opposition. Its decisions can be challenged in court. Its officers can be questioned. Allegations of wrongdoing can be investigated through lawful procedures. What cannot be accepted without scrutiny is the assumption that sustained political anger justifies every pressure tactic available. If Congress wants the public to believe that this is a straightforward anti-corruption exercise, it must demonstrate that the evidence, rather than the convenience of the target, is driving the process. What Changed After Twenty Years? This is the question Chennithala and the Satheesan government should answer clearly. What specific fresh material was unavailable to the original investigators? Why were the potential witnesses now named by Sajan not examined earlier? Has the purported suicide note been authenticated and obtained from the relevant authorities? What precisely is the legal and evidentiary basis for revisiting findings that the Vigilance Bureau previously considered unsubstantiated? These are not attempts to block an investigation. They are the minimum questions that distinguish a credible inquiry from a politically useful announcement. Congress must also account for an uncomfortable contradiction. Its own Home Minister has placed the closure of the earlier investigations on the Assembly record, while his government has now authorised another round of scrutiny. Both positions can coexist if genuine new evidence has emerged. But that explanation must be demonstrated, not assumed. Merely recycling an old allegation, repeating a claim about an unseen document or invoking the seriousness of a tragic death cannot substitute for evidence. Lee See Been's death deserves factual treatment and respect, not conversion into an instrument of political combat. Rahul Gandhi Cannot Escape the Larger Question Rahul Gandhi has made Gyanesh Kumar one of the most visible targets of Congress's nationwide campaign. That gives the party leadership a responsibility to explain the standards it expects its state governments to follow. There is no established evidence that Gandhi personally directed the Kerala inquiry, and none is needed to raise the political question. The issue is whether Congress's national messaging and Kerala's investigative actions now operate in a way that amplifies pressure on the same constitutional official. If the party insists these developments are entirely unrelated, it should be prepared to substantiate that claim through transparency and procedural discipline. A serious opposition must do more than keep raising the political temperature. It must separate evidence from accusation, institutional criticism from personal vilification, and legal action from public theatre. Congress's disagreement with Kumar may be profound. Its electoral objections may deserve hearings and answers. But those arguments will not acquire greater credibility through a parallel controversy that has yet to yield an established finding. A party claiming to protect democracy should know that the credibility of the process matters as much as the political identity of the person under scrutiny. Congress Risks Putting Its Own Credibility on Trial There is a simple standard Congress should welcome: let the Vigilance Bureau follow verifiable evidence, disclose the grounds for reopening the matter as far as law permits, and reach its conclusions without political choreography. If new facts establish misconduct, the law must take its course, regardless of Kumar's office. If the allegations fail again, Congress must accept that result with the same seriousness it claims to attach to due process. What the party cannot reasonably demand is that the public treat an inquiry as proof simply because the target is someone its leaders want removed. After two decades, the allegation against Gyanesh Kumar has returned at the very moment Congress is fighting to drive him from office. That coincidence is not proof of a conspiracy, but it is more than sufficient reason for public scrutiny of the party's motives. Congress wanted to put the Chief Election Commissioner on trial in the court of public opinion. By choosing this moment to revive an old, unsubstantiated case, it has also placed its own political judgment under examination. The more aggressively Congress pursues this campaign without showing compelling new evidence, the more it risks turning an attack on Kumar into an indictment of itself.
