Kerala elephants – Bharat Pulse News

The Supreme Court of India has stayed specific directions issued by the Kerala High Court regarding the use of elephants during temple festivals. The apex court's intervention came after concerns were raised about certain provisions conflicting with the 2012 rules on elephant welfare. Conflict with 2012 Elephant Welfare Rules The Kerala High Court's directives, aimed at facilitating the use of elephants in temple rituals and festivals, were challenged on the grounds that they contradicted the established norms of the 2012 Performing Animals (Registration) Rules. These rules ensure the welfare and protection of elephants involved in public performances. Animal rights organizations and activists contended that the High Court's directions overlooked the safety and welfare of the elephants, potentially exposing them to mistreatment and stress during festivals. Supreme Court's Stay Order Acknowledging the gravity of the matter, the Supreme Court issued a stay on the High Court's directions. The bench emphasized that all activities involving elephants must strictly comply with the existing legal framework to prioritize the animals' welfare. The Debate Around Elephants in Festivals Elephants have long been an integral part of temple festivals in Kerala, with many celebrations featuring decorated elephants as a central attraction. However, concerns about their treatment and welfare during such events have been a point of contention. Animal welfare groups argue that these majestic creatures often endure physical and psychological stress due to prolonged standing, exposure to loud noises, and inadequate care. On the other hand, traditionalists emphasize the cultural significance of elephants in these rituals. Implications of the Ruling The Supreme Court's stay underscores the judiciary's commitment to ensuring a balance between cultural practices and animal welfare. This ruling is expected to set a precedent for similar disputes in the future, emphasizing the need to align cultural traditions with modern legal and ethical standards. The matter will likely see further deliberations as the apex court examines the broader implications of the Kerala High Court's directions. Meanwhile, stakeholders await clarity on the legal framework governing the use of elephants in religious and cultural events.
