US President Donald Trump has warned that he will use his presidential veto powers to block legislation if Democrats take control of Congress following the November 3, 2026, midterm elections. Speaking as Democrats secured gains in the House of Representatives and approached a Senate majority, Trump described the veto as a powerful constitutional tool that could force political opponents to negotiate with his administration. Trump Threatens to Block Democratic Legislation Trump said he was prepared to reject bills passed by a Democratic-controlled Congress rather than accept policies opposed by his administration. He suggested that repeated vetoes could eventually encourage lawmakers to negotiate bipartisan agreements. The president also indicated that his administration could rely more heavily on executive authority to advance policies concerning immigration, trade and federal government operations. However, executive actions remain subject to constitutional and statutory limitations, including judicial review. How the US President's Veto Powers Work Under Article I, Section 7 of the US Constitution, legislation approved by both chambers of Congress must be presented to the president. The president can sign the bill into law or veto it by returning it to Congress with objections. Congress can override a regular presidential veto only with a two-thirds majority in both chambers. Assuming full membership and participation, that requires 290 votes in the 435-member House and 67 votes in the 100-member Senate. A president can also exercise a pocket veto when Congress adjourns under circumstances preventing the return of legislation. Democratic Congress Could Challenge Trump's Agenda Trump has exercised his veto power 12 times across his presidencies, with Congress successfully overriding one of those decisions. That override concerned the National Defense Authorization Act in January 2021. A Democratic-controlled Congress could challenge Trump over federal spending, immigration, emergency powers and military operations. However, major legislation would still require presidential approval or sufficient bipartisan support to override a veto. The new Congress takes office on January 3, 2027, setting the stage for potentially difficult negotiations over government funding and legislative priorities.
