Supreme Court to Close Most Hate Speech Petitions

The Supreme Court of India has said it will close the majority of public interest litigations related to hate speech that have been pending since 2021. A bench noted that central and state authorities have reported progress in registering cases and taking action, and the court reserved its order before deciding to dispose of most of the matters.

What Was Pending

These petitions were filed to push for stronger enforcement against hate speech and related crimes, and in some instances to ensure police take action by suo motu registering FIRs without waiting for formal complaints.

Court’s Reasoning

The bench said governments and police have submitted compliance reports on earlier court directions, and it will close the long-pending matters where enforcement steps have been reported. However, the court may keep specific cases alive where ongoing investigation or trial needs monitoring.

Legal and Social Context

Hate speech cases in India have been a focus of legal debate, involving questions on enforcement, law enforcement compliance, and protection of public order. The court’s move is part of broader efforts to reduce backlog and ensure judicial processes move forward.
