Supreme Court Names Judge to Resolve 30-Year NOIDA Flat Row
The Supreme Court has appointed former Allahabad High Court judge Justice Sudhir Kumar Saxena to independently verify genuine claimants in a three-decade-old NOIDA housing dispute involving the Kendriya Karamchari Sehkari GN Samiti.
Supreme Court Appoints Judge in NOIDA Housing Dispute
A bench led by Chief Justice Surya Kant constituted a one-member high-powered committee after observing that repeated directions and affidavits had failed to resolve disputes over the identity and number of eligible allottees.
The committee has been authorised to examine records, seek documents and hear individual claimants before finalising the list of genuine members and subsequent purchasers entitled to multi-storeyed flats.
Justice Saxena has been asked to submit his report within eight weeks.
Dispute Over Original Allottees and Buyers Continues
In 2022, the Supreme Court directed NOIDA to allot flats to 844 identified society members and examine claims made by 133 subsequent purchasers.
Later proceedings produced conflicting figures. The number of original members was revised to 863, while the number of subsequent purchasers was placed at 120.
NOIDA has opposed recognising some subsequent purchasers, arguing that original allotment conditions restricted transfers without prior permission and that allotments were cancelled in 1998.
The society has countered that NOIDA did not act on transfer applications and that refund cheques issued after cancellation were never encashed.
NOIDA Told to Assist Independent Committee
The Supreme Court directed NOIDA, the housing society and all claimants to cooperate fully with the verification exercise.
NOIDA has also been ordered to provide secretarial and logistical support to the committee.
The long-running dispute will return before the Supreme Court on December 2 after progress on the verification process.
