SC Seeks Firecracker Ban Across India, Not Just For Delhi

The Supreme Court questioned why the firecracker ban was enforced only in Delhi-NCR. Chief Justice B.R. Gavai said clean air is a right for all citizens, not just the “elite” in the capital. He asked why cities outside Delhi aren’t included.

Cases Brought By Manufacturers

Firecracker manufacturers from states like Haryana have challenged the year-long ban on manufacture, sale, and use of firecrackers in Delhi-NCR. They argued that many livelihoods are affected, particularly those dependent on the cracker trade.

Demand For Pan-India Policy

The bench, including Justices Gavai and Vinod Chandran, pressed for a national framework on firecracker regulation rather than localized bans. The Court stressed policies should be applied uniformly across India.

Environmental And Social Argument

Senior advocates highlighted that air pollution is severe in many cities beyond Delhi-NCR—sometimes worse. They also pointed out that poorer people, especially those working in the firecracker industry, are disproportionately harmed by bans without support.

Interim Orders And Next Steps

The Court asked the Commission for Air Quality Management (CAQM) to prepare a report. It also ordered that license cancellations for firecracker sellers and manufacturers be put on hold until the matter is heard again on September 22, 2025.
