SC Says Parents Can Be Held Responsible for Minor Driving
The Supreme Court of India said that parents or guardians can be held responsible if they allow minors to drive a vehicle, underscoring the need for adult supervision and adherence to driving laws. The court stressed that children should not be permitted to operate cars or motorcycles without valid licences.
Court’s Observations on Safety
The bench noted that permitting minors to drive poses serious road safety risks and can lead to accidents, injuries and loss of life. The court said parents must ensure that only licensed and capable individuals operate vehicles, and they could face legal consequences if they negligently allow underage driving.
Legal Context
Under the Motor Vehicles Act, driving a motor vehicle without a licence is an offense, and adults who facilitate or allow this can be held accountable. The court’s remarks were made while hearing a petition related to road safety and enforcement of traffic laws, and the bench indicated that actions may be taken to enforce responsibility on guardians when minors violate driving norms.
The ruling aims to reinforce road safety compliance and discourage risky behaviour by young, unlicensed drivers.
