SC: Railways Must Pay Victims Despite Technical Lapses
The Supreme Court has ruled that Indian Railways cannot deny compensation to accident victims solely on the basis of technical or procedural lapses. The court held that confirming a valid train ticket for the same date and route is sufficient to establish a bona fide claim.
Case Background & Judgment
The decision came while overturning judgments by the Madhya Pradesh High Court and the Railway Claims Tribunal, Bhopal, where a widow and her son had been denied compensation after a man died in a rail accident. The Supreme Court observed that claims under Section 124-A of the Railways Act are governed by the principle of preponderance of probabilities, not by the high standard of proof required in criminal cases.
What Constitutes a Valid Claim
The court emphasised that a “hyper-technical” approach should not be used to defeat legitimate claims. It noted that procedural irregularities or missing paperwork should not outweigh the underlying truth and hardship faced by victims or their families.
Implications for Future Claims
This ruling is likely to expand how claims are assessed across India. Future petitioners may find it easier to obtain compensation without worrying about rigid technicalities. Railways will need to adapt its claim rejection practices in light of the judgment.
