
SC Flags Divisive Content, Urges Self‑Regulation
The Supreme Court of India has called on citizens to exercise greater self-restraint on social media, warning that unchecked divisive content can harm social harmony. The Court reaffirmed the constitutional right to freedom of speech and expression, but added that this right comes with responsibilities.
During a recent hearing, the bench observed that the nature of online discourse is becoming increasingly polarised. It advised that public platforms should be used to encourage dialogue, not division.
Not Advocating Censorship
The Court was clear that it is not advocating censorship, but rather asking citizens to voluntarily avoid speech that is inflammatory, abusive, or misleading. The judges noted that no one wants excessive state intervention, but warned that abuse of free speech could invite stricter oversight in the future.
They said, “Citizens must understand the value of their freedom. The answer is not censorship, but mindful participation in public conversations.”
Fraternity And Responsible Expression
Emphasising the principle of fraternity in the Indian Constitution, the Court said free speech should be exercised in a manner that fosters unity and respect among all communities. The bench indicated that it is considering broader guidelines for responsible online conduct, especially to address the rise of misinformation and targeted harassment.
