Kerala HC Grants Interim Protection To MLA

The Kerala High Court has granted interim protection from arrest to Palakkad MLA Rahul Mamkootathil in a rape case. The order will remain in force until December 15, when the court will hear his anticipatory bail plea. The court noted that serious arguments had been raised by the defence and said it would consider them further before taking a final view.

Allegations Include Rape And Coercion

A woman has accused Mamkootathil of rape, coercion leading to abortion, criminal intimidation and breach of trust. She also alleged that videos were recorded without consent. The complaint was initially sent to the Chief Minister’s office before being forwarded to the police. Charges have been registered under relevant provisions of criminal law. Mamkootathil has denied the allegations, stating that the relationship was consensual.

Court Cites Need For Hearing

While issuing interim protection, the court said that an individual should not be subjected to arrest before being given an opportunity to be heard. The court also referred to procedural concerns raised by the defence. The protection is temporary and applies only until the next hearing date.

Political And Legal Pressure Continues

Mamkootathil had been expelled from his party earlier following separate allegations. Another complainant has recently come forward with accusations of sexual assault. The cases have created political fallout, and the MLA faces further legal scrutiny once the interim order expires.
