Delhi HC Questions Removal of GST Aid
The Delhi High Court has asked the Centre to explain why it removed a GST concession for the differently-abled on vehicle purchases. The court said taking away a benefit already granted is troubling.
What changed
Earlier, persons with locomotor disabilities were eligible for a lower GST rate on certain cars compared to the standard 28%. A new notification now applies a uniform 18% rate for all buyers, eliminating the special concession.
Petitioners raise rights concerns
The All India Confederation of the Blind filed a petition asserting that the change violates the rights of persons with disabilities under the RPwD Act. They argue that equal treatment should not mean removing targeted support for vulnerable groups.
Court’s demand
A bench led by Chief Justice D. K. Upadhyay directed the Centre’s counsel to get instructions and justify why a reduced rate cannot be applied specifically to persons with disabilities. The next hearing is set for December 17.
