Belgium Court Clears Extradition of Mehul Choksi

A court in Antwerp, Belgium has approved the extradition of fugitive businessman Mehul Choksi to India, rejecting his claims of political persecution. The court ruled that his arrest by Belgian authorities on India’s request was valid.

Charges and Fraud Case

Choksi is wanted in India in connection with a large-scale bank fraud at Punjab National Bank (PNB) amounting to approximately ₹13 000 crore, in which he and his nephew are alleged to have obtained Letters of Undertaking fraudulently. The Indian agencies contend that Choksi orchestrated the scam under various laws including the Prevention of Corruption Act.

Extradition Process & Assurances

India has provided extensive assurances to Belgian authorities regarding Choksi’s treatment upon return, including that he will be housed in Barrack No. 12 at Arthur Road Jail in Mumbai with adequate space, lighting, medical care and no solitary confinement. These measures were aimed at meeting European human-rights standards.

What Happens Next

Although the Belgian court approved the extradition process, Choksi still retains the right to appeal this decision to a higher court. If the appeals are exhausted and all legal conditions are met, his transfer to India can proceed to face trial. India views the ruling as a major step in its efforts to bring him home and hold him accountable.
